Questions & Answers
How can I learn more about the history of the tobacco industry’s conduct ?
Collections of internal and once secret documents of seven (7) major tobacco manufacturers provide tremendous insight into a long history of deception and manipulation and those collections can be found in our Tobacco Resource Center. The collection of documents were created from the files of Philip Morris USA, R.J. Reynolds Tobacco Co., Brown & Williamson and American Tobacco (B & W and American Tobacco have merged into R.J. Reynolds), Lorillard Tobacco Co., Liggett Group, LLC (formerly known as Liggett & Myers), and BAT Co.

How do I know if I case against a tobacco company?
Kelley / Uustal is committed to helping victims of Big Tobacco seek justice. The determination to proceed with a lawsuit is always a complicated process and because we cannot represent everyone who contacts us, we must limit our representation to those cases which we believe will serve the most good. Cases against a tobacco company are difficult. The tobacco industry is extremely large, has lots of resources, will fight claimants at every turn and will appeal pretrial rulings as well as the final judgment in any successfully tried case. If you or a loved one is sick or has died as a result of smoking cigarettes, the attorneys at Kelley/Uustal are here to answer your questions and discuss your potential case. In order for Kelley / Uustal to assist you in determining whether you, or a loved one, qualify to participate in the Trust Fund proceedings, we will need you to provide us with some basic information. We will need to know the following information: (1) were, or your deceased family member, a Florida resident as of November 21, 1996; and (2) did you, or deceased loved one, suffer from or die from a smoking related illness on or before November 21, 1996. What fees will I have to pay an attorney to represent me?
Most personal injury attorneys get paid only if you recover money for your claims. This is known as working on a "contingent fee" basis. If Kelley / Uustal agrees to handle your case, you pay them absolutely nothing until you are awarded a settlement or judgment.

How Do I Choose an Attorney?
First and foremost, look for a law firm that has a record of litigating and winning complex product liability cases and who has the resources to successfully take your case to court against large corporations. Some personal injury attorneys just try to settle your claims quickly and do not want to go to trial.
